Terms & Conditions of Sale

In the following text, Blue Power Tools, the seller, we, us and our mean Power Tool World Ltd. The buyer, customer and you mean any party entering into a contract to purchase from Power Tool World Ltd. These terms and conditions supersede any previous terms and conditions issued by Power Tool World Ltd.

1. These terms and conditions of business apply to all contracts to purchase goods entered into with Power Tool World Ltd, and these conditions shall over-ride and supersede any conditions of purchase stipulated by the buyer, unless and to the extent that any such conditions of the buyer have been specifically agreed in writing by us.
2. Payment terms – all orders will be paid for in full prior to being despatched. This will normally be by on-line authorised credit card payment. In the event of non-payment for goods supplied, Blue Power Tools reserves the right to take whatever steps we deem necessary to recover all monies owed, including any costs incurred in collecting such monies.
3. Prices – goods are invoiced at the price ruling at the date of order. If goods are offered for sale incorrectly we will always try to honour our offer. There may be rare circumstances where we are unable to do so. In such cases we will contact you to explain the situation. If we are unable to come to an agreement with you, we reserve the right to refuse your order and refund any payment you have made. We reserve the right to alter advertised prices without notice.
4. Retention of title – All goods are sold under retention of title terms. The ownership of goods shall not pass to the customer until full payment of the purchase price is made. However, the risk shall pass to the buyer on delivery. This clause shall not be over-ridden by any buyer’s conditions of purchase and orders are only accepted on this basis. Notwithstanding delivery and the passing of risk in goods, or any other of these conditions, the property of the goods shall not pass to the buyer until the seller has received in cash or cleared funds payment in full of the price of the goods and all other goods agreed to be sold by the seller to the buyer for which payment is then due.
5. Specification – the customer’s attention is specifically drawn to the manufacturer’s brochures and safety literature in respect of the correct use and application of products, which Blue Power Tools may supply. The customer shall be wholly responsible for ensuring that such products are entirely appropriate for the use and application to which they might be put. The specification and description of goods on our website is correct to the best of our knowledge and no liability shall be accepted for any errors. As manufacturers reserve the right to change specification without notice customers are advised to confirm the exact specification of goods prior to purchase.
6. Availability – we aim to keep sufficient stock to fulfil all orders. If we are unable to supply or deliver the goods ordered by you we may at our discretion; delay your order if the goods are expected to be in stock imminently, offer a substituted product or refund you the price paid for such goods as soon as possible. In any instance we will endeavor to keep you informed of the status of your order.
7. Cancellation – you may cancel your order at any time until the goods have been despatched. If you wish to cancel your order you should do so by telephone and we will confirm that it has been possible. Please bear in mind that your goods will usually be packed and despatched very shortly after your order is received. If your goods have already been despatched then your order cannot be cancelled although you can arrange to return your goods.
8. Returned goods – any goods purchased from our website, which are still in new, unused condition and have all their original packaging, can be returned to us within 30 days of the purchase date for a refund or credit of the original purchase price in full. In these circumstances the cost of returning goods is the customer’s responsibility. In any case where goods are returned for any reason, and Blue Power Tools agrees to issue a refund, our liability is limited to the original purchase price of the goods including any delivery costs. Where the goods are being returned because they are faulty from new, incorrect goods or because of unsuitable substitution by us, we will meet the cost of return but we ask that you allow us to nominate the carrier. If goods are returned under a warranty claim, the customer is liable for any costs incurred in returning the goods to us or any other authorised warranty service agent.
9. Liability – Nothing in these terms and conditions of sale is intended to affect your statutory rights or to limit our liability for death, personal injury or fraudulent misrepresentation resulting from our negligence. Our liability to you will always be limited to a full refund of the goods purchased. We will not compensate for delivery delays or failures. In these circumstances our liability will be limited to a refund of any carriage charges paid by you at the time of the original transaction. Our liability to you specifically excludes compensation for indirect or consequential loss or damage however it occurs. In any case, Blue Power Tools liability is limited to the original purchase price of the goods.
10. Delivery – deliveries made on our behalf by a carrier are subject to our current carriage terms. This will be stated at the time of ordering.
11. Unforeseen Circumstances – we shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation; strikes, lockouts, industrial disputes, wars, acts of terrorism, floods, power cuts etc.)
12. Shortages – short delivery or receipt of damaged goods must be advised within 5 working days of delivery quoting our document reference number. We will endeavour to rectify the problem as quickly as possible. Claims submitted after this period will not be valid.
13. Warranty – all goods are supplied subject to the manufacturers warranty terms. In addition, any non-powered tool or accessory found to have a manufacturing defect is replaced regardless of age. In this instance Blue Power Tools reserves the right to replace a faulty product with a substitute of equivalent value or to refund the original purchase price. In all instances Blue Power Tools liability is limited to the original sale value of the faulty product. No claim is accepted where goods have been used for a purpose for which they are not intended, fitted incorrectly, not maintained to the manufacturers recommended standards, have failed due to fair wear and tear or have been misused or abused. All goods that we supply are intended for use in the UK and we make no warranties that the goods are suitable for use outside the UK, or comply with any laws, regulations or standards of any jurisdiction outside the UK. Manufacturers’ warranties may be invalidated if the goods are used outside the UK.
14. General – if any part of these conditions is invalid, illegal or unenforceable, the validity, legality or enforceability of any other part of these conditions will not be affected. These terms and conditions of business and any contract between Blue Power Tools and you shall be governed by and interpreted in accordance with English law.
